Covenants, Conditions & Restrictions Referred to as the C. C. & R.s, this document is the constitution of the Homeowner's Association. Filed with the Maricopa County Recorder, it is the legal definition of the Association, the buildings and the property itself. In it are defined the reponsibilities of the Board of Directors, the Management Company and the Homeowners. The C. C. & R.s answer many questions the homeowner may have and covers the rules of the Association not otherwise spelled out in the Rules & Regulations document.
The Rules and Regulations are part of the daily operating guidelines of the Assocition and are intended to complement and enhance the C. C. & R.s. They are drawn up by the Board of Directors and can be amended, if needed, by a vote of the Board. They include things like noise guidelines, parking rules, and rules covering the pool among others. This is an essential document for the Board in its decision making process
The Bylaws are the rules set forth by the Association defining the Board of Directors of the Association. They cover how officers are elected, what their responsibilities and duties are, and how meetings are to be conducted. The Bylaws explain how your Board actually works
